Why proportionality does not apply to Israel’s defence against Hamas and Gazan civilians.

Does proportionality apply to Israel? This is not two countries fighting each other. It is a terrorist group fighting a country. It is a terrorist group that by its actions on Oct 7th proved that it has no problem in committing atrocities against Israel, in fact they were and still are proud of them. In addition, Hamas says that it is a war initiated by them to conquer all of Israel and kill all Israeli Jews as well as all world Jews. What if anything is the response to this claim?

There has been a lot of talk about Israel acting proportionately in its defence against Hamas. I suggest that the concept does not apply to a case of continuous attempts to destroy the nation of Israel and its Jewish people. In simple words, it does not apply to defences against attempted genocide and promises of future attempts of genocide.

So, to begin, as this is obviously a war, Hamas should be prosecuted for wicked or ruthless crimes against humanity for its actions on Oct. 7th, for its abducting civilians, and for its ruthless treatment of those abducted, particular for its rape of captured women. Hamas is not a state, however its crimes against humanity should be publicly dealt with and those responsible should be held accountable.

Secondly, how would proportionality apply to Israel? Hamas has claimed on behalf of all Palestinians to destroy Israel, kill all Jews in the world and to continue fighting until it or Israel is destroyed. What is the proportionality to this? It leaves Israel with no choice but to destroy Hamas and its followers. completely. Proportionality applies to mistreatment of civilians Here there is no question. Israel does not torture or otherwise abuse Hamas prisoners – it only kills the enemy in war, unlike Hamas.

The law of proportionality deals with unnecessary harshness against a civilian population.“Innocent civilians” are defined as people who don’t belong to the attacking group and don’t participate in their aggressive behaviour. What is the status of Hamas’s civilians? Should they be considered to be innocent civilians? Who are “innocent civilians” in Gaza. I suggest that there aren’t any. 

They elected Hamas. They train their children using Hamas and UNWRA textbooks to hate Israel and Jews. They also train them in fighting and the use of weapons and that dying for Islam is admirable. Gazan children are the next generation of Hamas terrorists. Gazan and other Palestinian civilians kill Jews in areas controlled by them or Fatah. Often rocks are thrown at Jewish cars causing serious or deadly damage. Gazan and other Palestinian civilians often celebrate any terrorist murder of a Jew in Israel by handing out candies and singing. All this indicates agreement by Gazan civilians with and support of Hamas and its antisemitic ideology. Additionally no Gazan told Israel where to find the surviving kidnapped survivors who are undoubtedly being brutalized in Gaza today. Does that not make them supporters of Hamas? 

Although Gazan civilians were often friends with Jews from nearby towns, no Gazan warned their Jewish friends of the upcoming massacre and some even participated in the mass murder and brutalization that occurred on Oct 7th. Lastly we know that friendly Gazans were used to spot out weaknesses in Israeli defense systems and to notify Hamas. These Gazans were not innocent citizens but spies and deserve anything that Israel does to them. 

Gazan civilians are Muslim and Hamas claims to be driven by religious fervour to kill Jews. Does that impose a religious duty on some Gazans to support Hamas? Hopefully not. No Gazan told Israel where to find the surviving kidnapped survivors who are undoubtedly being brutalized in Gaza today. Does that make them supporters of Hamas? Are all the above the way innocent people behave? No it is not, and therefore we must conclude that Gazan civilians are not innocent onlookers but participants in Hamas’s objectives to destroy Israel and all Israeli Jews.

The civilian population of Gaza are not “innocent civilians” who should be protected by the theory of proportionality. They are supporters of the terrorist organization that rules them. They are not innocents and should not be treated as innocents after their leaders have committed atrocities against truly innocent civilians, most of whom were misinformed peacemakers.

So, if Gazan civilians are supporters of Hamas, and Hamas threatens to kill all Israeli Jews and all the Jews of the world, what is the proper proportionate response? Is a proportional response to kill all members of Hamas and their Gazan civilian supporters? Is it to kill or deport all Muslims or all Muslims who claim to be Palestinians? Can Muslim Palestinians ever again be trusted by Israel? Surely a very tough response is required against all those who threaten all Jews with mass torture and murder.

Hamas’s claim for proportionality on behalf of its supporters is bogus. It puts its war apparatus in hospitals and schools among its citizens so that when they begin a war, their fighters will claim that any attack on them is an attack on civilians and not proportional. But it is a false claim because Hamas intentionally puts Gaza in danger and the Gazan civilians are not innocent civilians, they are proven supporters of Hamas and its desire to destroy Israel and all Jews.

Is Israel acting proportionately. I don’t think proportionality applies to Gaza. Gazans are not “innocent civilians” but are supporters of their government. They are not being butchered as they did to the Israelis. They are being killed as active supporters of the destruction of Israel and the butchering of Israelis.

Proportionality is a claim by Hamas to be able to stop the Israelis so that they can gain strength and attack them again as soon as they are strong

enough. It should not be attempted to be applied against Israel by a now proven anti-Semitic and anti- Israel United Nations organization

Lastly proportionality refers to doing cruel things to enemy civilians. Cruelty is what Hamas has done to peace loving Israelis living near its borders. Killing or deporting Gazans to create peace, to avoid a threatened renewed war in two years and in fact forever is not cruelty, it is simply protecting Israelis from the claims of Hamas to perpetually fight until the end of Israel and the death of all Jews.
