B’nai Brith Canada has taken legal action against long-time anti-Israel activist David Mivasair for defaming their organization. Mivasair had been formally notified and given the opportunity to retract numerous false public statements, issue a public apology, and commit to refraining from making further defamatory remarks about B’nai Brith. However, as he failed to respond, the organization has decided to pursue legal remedies through the court system.
The defamatory statements made by Mivasair include baseless claims that labeled B’nai Brith as an “anti-Palestinian hate group,” “racist,” an “agent of a foreign power,” and a “small band of extremists enabled by wealthy racists.” These damaging statements were not expressed as opinions but were deliberate attempts to spread false information with the intention of discrediting and causing harm to B’nai Brith, a respected human rights organization.
Mivasair, known for his involvement with the controversial anti-Israel group Independent Jewish Voices (IJV), allegedly holds the title of Reconstructionist Rabbi. In 2021, he faced arrest and vandalism charges for pouring red paint on the steps of the Israeli Consulate in Toronto. Additionally, his social media presence has showcased displays of anti-Zionism, antisemitism, and even trivialization of the Holocaust.
One of Mivasair’s tweets in November 2022 sparked outrage, as he controversially suggested that mandatory Holocaust education aimed to keep Jews “special, never normal.” In an earlier tweet, he expressed the belief that “Israel shouldn’t exist as a Jewish state” and accused it of being racist. Such statements not only perpetuate harmful stereotypes but also undermine the historical significance of the Holocaust.
Michael Mostyn, the Chief Executive Officer of B’nai Brith, emphasized the importance of distinguishing between personal opinions and defamatory remarks. Mostyn stated, “Everyone is entitled to their own opinions. However, he has repeatedly defamed our organization, which acts as a mainstream national voice of the Jewish community, with false and harmful statements.” Unless Mivasair issues an apology, retraction, and commits to refraining from making future defamatory statements, legal action will proceed.
B’nai Brith Canada has long been a respected advocate for human rights and a prominent voice within the Jewish community. Their commitment to combating defamation and ensuring the accurate representation of their organization is paramount. By pursuing legal remedies, they aim to uphold their reputation and send a strong message that false accusations and harmful rhetoric will not go unchallenged.
